Who Chooses my Doctor if I'm Injured at Work?

Under Florida Worker’s Compensation Laws, there are a number of restrictions on injured workers. For example, injured workers are required to report work-related injuries to their employers in a limited amount of time. Also, depending on the severity of the injuries, the amount of time in which an injured employee can collect his or her payout may vary.

Perhaps one of the most shocking restrictions placed on injured workers is the inability for injured workers to select their own doctors for the examination following their injuries. Worker’s Compensation law requires that if an injured worker requires medical attention, the employer’s insurance carrier chooses the doctor who will perform a medical examination on the injured worker.

However, there are a few exceptions to this rule. An injured worker can request a change of physician. This request will give an insurance carrier five (5) days to choose a different physician to perform the examination. If the insurer fails to select a new physician within the given time, the injured worker may then select the doctor of his or her choosing. This request is a one-time option, and injured workers may not make this request more than once.

For Worker’s Compensation cases, the doctor can make all the difference. The physician who conducts your examination will determine whether your injuries are severe enough to return to work, or how long you should receive benefits. As expected, doctors appointed by your employer are far more likely to side with the employer over the severity of your injuries.

Many workers are rejected during these initial stages and are left to fend for themselves. Unfortunately, you cannot always rely on these physicians to consider the long-term effects of your injuries.
